Divorce should be granted when the couple has no interest of reuniting: High Court

The Punjab-Haryana High Court has ruled that divorce should be granted when the couple has no chance of reuniting. Gurugram Family Court erred in dismissing a petition filed by a man for divorce. A married couple split up. All attempts at means such as mediation to reconnect them have failed. They have been separated since 2003.

The husband went to court for a divorce. He was willing to pay alimony to his wife. But his wife did not agree and his petition was dismissed by the court in 2015. He appealed to the High Court challenging the verdict. The High Court held that the spouses were not in a position to be together in this case. The divorce was granted stating that the husband would be able to move on in his life if the divorce was granted.
